Can A US citizen petition a brother who is in the United States working legally


Can A US citizen petition a brother who is in the United States working legally?
If yes, does the brother have to go back to their country while the process of adjustment of status is on going?

Yes, you can. However, the wait for a visa is VERY long. From most countries it's an 11 year wait except for Mexico (14 years) or the Philippines (23 years). Your brother can only wait in the USA as long as he has a valid visa. If his work visa expires he'll have to wait in his own country.

if the brother is here already and has immigration doing proper paper work to keep him here legally he needs to stay in the u.s. 8 yrs ago we started a working permit for a mexican chef that was here illegally and because he went to mexico and came back a month later his paper work was denied and he was at the end of the process he already have a working alien permit and a social security and was at his last meeting for his green card and because he left the country he was denied
